These Terms and Conditions ("Terms") govern your use of the website located at customsafetyvests.com and any related services provided by CustomSafetyVests.com ("we," "us," or "our").

By accessing this website or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

These Terms constitute a legally binding agreement between you and CustomSafetyVests.com. By using our services, you represent that you are at least 18 years of age and have the legal authority to enter into this agreement.

Order Acceptance: All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, pricing errors, or suspected fraud.

No Minimum Order: We do not require a minimum order quantity. You may order as few as one (1) item with custom printing.

Payment Terms: Payment is due upon proof approval unless otherwise agreed in writing. We accept major credit cards and, for established accounts, purchase orders and net terms. All payments are processed securely through our payment processor.

Order Confirmation: You will receive an email confirmation after placing your order. This confirmation does not constitute acceptance of your order; acceptance occurs when we ship the products to you.

Pricing Errors: In the event of a pricing error on our website, we reserve the right to cancel any affected orders and offer a corrected price or refund.

Shipping Rates: Free freight is provided on all orders shipped within the United States. For all other shipments, freight costs are assessed at the time your order is completed.

Delivery Time: Orders ship within 3 business days after proof approval. Delivery times vary based on shipping method and destination. International orders may take longer due to customs clearance. Orders over 250 units may require additional production time, which we will confirm at proof.

Risk of Loss: Risk of loss and title for items purchased pass to you upon delivery to the carrier. We are not responsible for delays, lost, or damaged shipments once in the possession of the carrier.

International Orders: For orders shipped outside the United States, you are responsible for all customs duties, taxes, and import fees. We cannot predict and are not responsible for these charges.

Address Accuracy: You are responsible for providing an accurate and complete shipping address. Additional fees may apply for address corrections or redelivery attempts.

Artwork Submission: By submitting artwork or a logo for printing, you confirm that you own or have the legal right to use the submitted design. You are solely responsible for ensuring your artwork does not infringe on any third-party intellectual property rights.

Digital Proofs: We will provide a digital proof for your review and approval prior to production. You are responsible for reviewing the proof carefully and confirming that all details are accurate. Once you approve the proof, production will begin immediately.

Color Matching: We will make reasonable efforts to match colors accurately. However, due to variations in printing processes, materials, and monitor displays, we cannot guarantee an exact color match. Minor color variations are not grounds for rejection or refund.

File Quality: We reserve the right to request higher-resolution files if the submitted artwork does not meet our minimum quality standards for printing. We are not responsible for print quality issues resulting from low-resolution or poorly formatted artwork.

Design Assistance: We offer basic design assistance and logo vectorization at our discretion. Additional fees may apply for extensive design services.

Pricing: All prices are listed in U.S. Dollars (USD) and are subject to change without notice. Price changes will not affect orders that have already been placed and confirmed.

Bulk Discounts: Volume discounts are available for large orders. Contact us at info@customsafetyvests.com or call 952-463-8392 for custom pricing on orders exceeding 1,000 units.

Taxes: Sales tax is applied to orders as required by applicable law. If you are tax-exempt, please provide your tax-exempt certificate prior to placing your order. To the extent we are not required to collect sales tax on your purchase, you are solely responsible for reporting and remitting any and all sales, use, or other similar taxes required by your state or locality.

Customer Tax Obligations: You are responsible for determining, reporting, and paying any sales tax, use tax, or similar taxes imposed on your purchase by your jurisdiction, whether or not such tax is collected by us at the point of sale. If any taxing authority subsequently assesses additional taxes, interest, or penalties on your purchase, you agree to pay such amounts and to indemnify, defend, and hold harmless CustomSafetyVests.com, its officers, directors, employees, and agents from and against any and all such assessments, claims, liabilities, costs, and expenses arising therefrom.

Additional Fees: Rush production, expedited shipping, design services, and other add-on services may incur additional fees, which will be communicated to you prior to order confirmation.

Custom Products: Because all custom-printed products are made to your specifications, we generally cannot accept returns or exchanges on items with custom printing. Please review your digital proof carefully before approving production.

Non-Custom Items: Non-custom items (if any) may be returned within 30 days of delivery for a full refund, provided they are in unused, original condition. Return shipping costs are the responsibility of the buyer.

Damaged or Defective Products: If you receive a product that is damaged, defective, or differs materially from what was approved on your digital proof, please contact us within 5 business days of receipt. We will work with you to replace the item or issue a refund.

Artwork Errors: If an error on our part results in a product that does not match your approved proof, we will reprint the order at no additional cost or issue a refund. We are not responsible for errors that resulted from your approval of an inaccurate proof.

Process: To initiate a return or report a damaged product, please contact us at info@customsafetyvests.com with your order number and a description of the issue.

Product Warranty: Our products are backed by a limited warranty against manufacturing defects in materials and workmanship for a period of 30 days from the date of delivery.

Safety Standards: Our safety vests are designed and manufactured to meet or exceed ANSI/ISEA 107 standards. However, we make no warranty regarding the suitability of our products for any specific work environment or application.

Printed Logo Durability: Printed logos are warranted against cracking, peeling, or significant fading for one (1) year from delivery under normal use, provided the care instructions are followed. Machine wash warm, tumble dry low. Do not bleach or iron directly on the print.

Disclaimer: EXCEPT AS EXPRESSLY SET FORTH HEREIN, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Intended Use: Our products are intended for occupational safety and identification purposes. They are not toys and should not be used for any purpose other than their intended use.

OSHA & ANSI Standards: Our safety vests are designed to meet ANSI/ISEA 107 standards. Compliance with these standards does not guarantee safety in all situations. It is the employer's responsibility to assess workplace hazards and select appropriate PPE.

Part of a Safety Program: Our vests are certified to ANSI/ISEA 107:2020 Type R, Class 2. High-visibility apparel is one element of workplace safety and does not replace hazard assessment, training, or other required protective equipment. It is the employer's responsibility to determine what PPE is appropriate for a given work environment.

Prohibited Uses: You may not use our products for any illegal purpose, or in any manner that could damage, disable, or impair our website or services.

Your Content: You retain all ownership rights to the logos and artwork you submit for printing. By submitting artwork, you grant us a limited, non-exclusive license to use, reproduce, and print your artwork solely for the purpose of fulfilling your order.

Our Content: All content on this website, including but not limited to text, graphics, logos, images, and software, is the property of CustomSafetyVests.com and is protected by U.S. and international copyright and trademark laws.

Trademark License: We grant you a limited, non-exclusive, revocable license to use our website and services in accordance with these Terms. This license does not include any right to copy, reproduce, or use our trademarks, trade dress, or copyrighted materials without our prior written consent.

Infringement Claims: If you do not own the rights to the artwork you submit, you may be violating the intellectual property rights of a third party. You agree to indemnify us against any claims arising from your use of artwork you do not have the right to use.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CustomSafetyVests.com, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) our website or services
• Any content obtained from our website or services
• Unauthorized access, use, or alteration of your transmissions or content
• The performance or non-performance of our products in any work environment
• Any injury or death resulting from the use of our products

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCTS GIVING RISE TO SUCH CLAIM.

If you have any concern about a charge, contact us directly at 952-463-8392 or info@customsafetyvests.com before disputing it with your card issuer. We resolve billing issues promptly and fairly, and we would rather fix a problem than have it go through a dispute process that helps neither of us.

Because all products are custom-printed to your specifications and produced only after you approve a digital proof, we retain your approved proof, order confirmation, and delivery records for every order. These records are provided to the card issuer in the event of a dispute.

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our website or services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use our services.

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, United States of America, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of our website or services shall be resolved by binding arbitration, rather than in court. The arbitration shall be administered in Hennepin County, Minnesota.

The arbitration shall be conducted on an individual basis — not as a class, consolidated, or representative action — under the commercial rules of the American Arbitration Association (AAA) then in effect. The arbitrator, and not any federal, state, or local court or agency, shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of these Terms, including any claim that any part of these Terms is void or voidable.

Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. This arbitration provision does not preclude you from bringing issues to the attention of federal, state, or local agencies, which may, if the law allows, seek relief against us on your behalf.

These Terms, together with our Privacy Policy and any other legal notices published by us on this website, constitute the entire agreement between you and CustomSafetyVests.com regarding your use of our website and services, and supersede all prior agreements and understandings, whether written or oral.
